Corinth PD Automated License Plate Reader Policy
I. PURPOSE The purpose of this policy is to establish the guidelines for the proper use of the ALPR by the members of the Corinth Police Department while maintaining compliance with applicable state and federal laws. II. POLICY The Corinth Police Departments ALPR Policy defines a minimum set of guidelines to govern the use of ALPR Data to enable the collection and use of such data in a manner consistent with respect for an individuals privacy and civil liberties. Employees shall abide by the procedures outlined in this directive when using the ALPR systems, thereby increasing the efficiency and effectiveness of this department's public safety efforts in a manner that also safeguards the privacy concerns of the general public. III. DEFINITIONS A. ALPR - is a generic acronym for Automated License Plate Recognition, Automated License Plate Reader, or License Plate Recognition (LPR). ALPR Systems can be implemented in multiple configurations: mobile (vehicle-mounted cameras), portable (stationary systems that are set up at a single point and moved when operations are complete), and fixed (cameras mounted to a fixed object such as a designated pole, traffic signal, light pole, highway overpass, etc.). The Corinth Police Department will only utilize the fixed camera option for all FLOCK cameras that are deployed. B. Hotlist - A list of known license plates and vehicles of interest, which are stolen, wanted for, or potentially associated with unlawful activity or missing persons. C. Read Record - A record of a plate that was read by ALPR that was not associated with any hotlist at the time it was captured. D. Hit Record - A record of a plate that was read by ALPR that matched a plate number on a hotlist and generated an alert. E. Hotlist Administrator  Authorized personnel whose duty is maintaining the ALPRs hotlist. F. Confirmed ALPR Alert  A visual confirmation that the license plate matches the information captured by the ALPR and reported in the corresponding alert to include the correct state of origin. The license plate information is confirmed with the National and Texas Crime Information Centers (NCIC/TCIC) when applicable. G. Hotlist Alert Categories - This is a list of the offense categories that will trigger a hotlist alert: 1. Amber Alert 2. Armed Robbery 3. Assault 4. Attempt to Locate 5. BOLO 6. Capias Warrant 7. Felony Warrant 8. Fugitive 9. Gang or Suspected Terrorist 10. Hit and Run 11. Homicide 12. Law Enforcement Suspect 13. Misdemeanor 14. Missing Person 15. Narcotics 16. Protection Order 17. Reported Lost/Missing 18. Stolen License Plate 19. Stolen Vehicle 20. Suspect 21. Threats to Law Enforcement 22. Violent Person 23. Wanted Person 24. Wanted Vehicle 25. Warrants IV. PROCEDURES A. Use of Automated License Plate Reader (ALPR) Equipment 1. The ALPR systems are the property of the City of Corinth. Officers use of ALPR equipment is restricted to public safety related missions of the department. Department members shall not use, or allow others to use, the equipment or database records for any unauthorized purpose. a. Appropriate use for the ALPR system includes, but are not limited to: i. Identifying stolen or wanted vehicles, stolen license plates, and missing persons. ii. Locate and apprehend individuals subject to active arrest warrants or otherwise lawfully sought by law enforcement. iii. Locate witnesses and victims of crime. iv. Locate missing and elderly individuals, including responding to any state or local issued alerts. v. Support local, state, federal and tribal public safety departments in the identification of vehicles associated with targets of criminal investigations, including investigations of serial crimes. 2. The ALPR may be used for other than patrol functions, when authorized by the Chief of Police, when articulable information exists to establish sufficient facts to give an Authorized User reasonable suspicion to believe that a particular individual, entity, or vehicle may be involved in definable criminal activity. 3. ALPR may be used to canvass license plates in a public area around any crime scene. Partial license plates reported during major crimes can be entered into the ALPR system to help identify suspect vehicles. 4. Officers who conduct a law enforcement action based on a Confirmed ALPR Alert will consider the level of risk associated with the nature of the offense and ensure that their response complies with all applicable statutes, City, and department policies. 5. Unless authorized by the Chief of Police, ALPR will not be utilized in any vehicle that is not identifiable as a Corinth Police Department vehicle. B. Prohibited Use Use of an ALPR is restricted to the purposes outlined below. 1. Except when done pursuant to a court order or exigent circumstances, it is a violation to utilize the ALPR to record license plates out of public view where there is a reasonable expectation of privacy. 2. It is a violation to use the ALPR systems and its associated data to harass or improperly intimidate any individual or group. 3. The ALPR systems and associated data shall not be used solely to target an individual or group based on race, gender, religion, political affiliation, nationality, ethnicity, sexual orientation, or disability. 4. No ALPR operator may access confidential department, state, or federal data unless authorized. 5. The ALPR system and any associated data shall not be used for personal reasons and are only authorized for legitimate law enforcement purpose. 6. The ALPR system shall not be used for any Class C misdemeanor related offenses. C. Data Security, Access, and Accountability 1. Only authorized personnel shall have access to ALPR data. 2. The Professional Standard section will audit ALPR searches every six months and prepare a report for the Chief of Police. 3. ALPR data shall be kept in a secure data storage system with access restricted to authorized users. This information is considered confidential to the extent permitted by law. 4. ALPR systems, associated equipment, and databases are authorized for official public safety purposes. Personnel who misuse this equipment and associated databases or data may be subject to disciplinary action, up to and including termination of employment. 5. ALPR systems, ALPR data, and associated media are the property of this agency and intended for use in conducting official law enforcement business. 6. Officers may only access stored data to perform a legitimate law enforcement function. Officers shall include the incident report number or call for service number, if available. 7. Designated personnel shall check equipment regularly to ensure functionality and camera alignment. Any equipment that falls outside expected functionality shall be reported immediately to the Field Operations Commander. D. Storage and Retention 1. The Corinth Police Department is submitting reads through FLOCK Safety directly to DPS. We send reads back to DPS every 24 hours and retain the data for 30 days. 2. Hits shall be retained no longer than necessary for legitimate law enforcement purposes. 3. If a hotlist attachment is made to the system, it shall be the responsibility of the Hotlist Administrator to include an expiration date for the attachment in the system. If the hot list attachment is no longer needed before it is due to expire, the Hotlist Administrator shall immediately remove the hit from the system manually. V. FLOCK CAMERA LOCATIONS A. Any previous directive, rule, order or regulation that pertains to this subject matter and its amendments shall remain in full force and effect for any violation(s) which occur prior to the effective date of this General Order. B. If any section, sentence, clause or phrase of this General Order is, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this General Order. C. All training on this General Order will be in accordance with General Order 100, Written Directive System, Chapter VIII, Training. D. The effective date is stated in the header block of this General Order.
